Equal Protection for Every Image-Bearer

From the moment of fertilization until natural death.

A Simple Claim

Abolitionism begins with a simple claim: every human being is an image-bearer of God from the moment of fertilization and is therefore entitled to the equal protection of the law until natural death. Killing that image-bearer with malice aforethought is murder. Civil government is established by God and has a duty to prohibit and punish that murder without partiality—without creating a separate, lesser category of human being whose death may be arranged or procured with legal immunity.

The Consistent Application of Scripture

This is the consistent application of Scripture. God commands rulers to show no partiality, to deliver those being taken away to death, and to protect the fatherless and the oppressed (Deut. 1:17; Prov. 24:11–12; Ps. 82:3–4). The unborn child is not a special exception to that command. The same standard that applies to a born child applies to the child in the womb.

West Virginia's Exemption

Most abortion statutes, including West Virginia’s, reject that standard in practice. Our state’s Unborn Child Protection Act declares abortion illegal in nearly all cases. At the same time, the code states:

This section shall not be construed to subject any pregnant female upon whom an abortion is performed or induced or attempted to be performed or induced to a criminal penalty…West Virginia Code, Unborn Child Protection Act

Parallel exemptions appear elsewhere in the code. The child is protected on paper; the mother who obtains the killing is categorically shielded from criminal liability as principal, accessory, accomplice, conspirator, or aider and abettor. That is not equal protection. It is a legal permission for one class of people to arrange the death of another.

What Has Happened Since Dobbs

The practical result has been visible since Dobbs. West Virginia has no abortion clinics and maintains a near-total ban. In-state clinic abortions fell from 1,015 in 2019 to 12 in 2023, 16 in 2024, and 20 in 2025. Yet the total number of known abortions of West Virginia children has risen. Foundation to Abolish Abortion data show 1,745 total abortions in 2019, compared with 2,330 known abortions in 2023, 2,330 in 2024, and 2,468 in 2025.1 The increase is driven by out-of-state travel (2,320 in 2023; 1,680 in 2024; 1,700 in 2025) and by telehealth abortions obtained under shield laws. When the law grants special murder rights by exempting mothers, the prohibition is incomplete by design.

The "Second Victim" Claim

The same exemption is defended by much of the organized pro-life movement under the claim that the mother is a “second victim.” When equal-protection bills have been introduced in other states, pro-life organizations have testified against them and pressured legislators who support them. The argument rests on a selective empathy that Scripture does not authorize. It treats the child’s death as a regrettable outcome for which the mother bears no moral or legal responsibility, while continuing to call the act a grave wrong.

Truth, Repentance and Grace

Telling a mother who has murdered her child that she did nothing wrong is a lie that obscures the need for repentance and faith in Jesus Christ. Justice is established by God’s law. Forgiveness for breaking it comes only through repentance and faith in the righteousness of Christ. Abolitionism tells the truth about abortion – it’s murder – and calls abortive mothers to repentance and grace.

Equal Protection

Equal Protection legislation extends to the pre-born the same legal protection already afforded to the born, consistent with the Fourteenth Amendment and the biblical prohibition on partiality.

Equal Protection West Virginia exists to advance that standard in this state. We call on legislators to remove the exemptions that shield the killing of the unborn and to enact laws that protect every image-bearer without sinful partiality.
